Overview

BidHound provides tools to help contractors find, research, and track government contracting opportunities, and offers SAM.gov registration assistance services. You are responsible for how you use the information and services we provide.

1. Eligibility
   You must be at least 18 years old and legally authorized to enter into contracts on behalf of yourself or your business. By using the Service, you represent that all information you provide is accurate and complete.

2. Accounts
   You are responsible for maintaining the confidentiality of your login credentials, all activity under your account, and not sharing your account with others. We may suspend or terminate accounts that violate these Terms or pose security risks.

3. Acceptable Use
   You agree not to use BidHound for unlawful purposes, attempt to access data you are not authorized to access, interfere with or harm the Service, resell or redistribute SAM.gov data in violation of federal rules, or scrape or bulk-download data in ways that violate our data source agreements.

4. Payments & Subscriptions — NON-REFUNDABLE
   All fees paid to BidHound are non-refundable, including but not limited to:

BidHound Pro subscription ($100/month): Billed monthly in advance. Non-refundable. You may cancel at any time, but no prorated refunds will be issued for unused portions of a billing period.

SAM.gov Onboarding Service: This is a one-time service fee. Payment is non-refundable under any circumstances, including but not limited to: delays caused by government processing times, rejection of your SAM.gov application due to inaccurate information you provided, failure to respond to our team's requests for required documents, or your decision to no longer pursue SAM.gov registration after payment.

We do not guarantee SAM.gov registration approval. Approval is solely at the discretion of the U.S. federal government. BidHound's service fee covers the work performed on your behalf, not the outcome.

Failure to pay may result in immediate suspension of your account.

6. SAM.gov Onboarding Service — Scope & Limitations

When you purchase the SAM.gov Onboarding service, BidHound agrees to assist you in preparing and submitting your SAM.gov registration. You acknowledge and agree that:

• SAM.gov registration is a free government service. Registration on SAM.gov (System for Award Management) is provided at no cost by the U.S. federal government at sam.gov. The fee you pay to BidHound is solely for our administrative assistance, guidance, and preparation services — not for access to SAM.gov itself.

• BidHound is not affiliated with SAM.gov, the U.S. General Services Administration (GSA), or any agency of the U.S. federal government. We are a private company providing assistance services. Use of BidHound does not constitute a government endorsement of any kind.

• SAM.gov registration is administered by the U.S. federal government. BidHound has no control over processing times, approval decisions, or government system outages.

• You are responsible for providing accurate, complete, and truthful information. Any delays, rejections, or legal consequences resulting from inaccurate information are solely your responsibility.

• BidHound is not a law firm and does not provide legal advice. Our service is administrative assistance only.

• Processing timelines are estimates only and are not guaranteed.

• You will cooperate with our team in a timely manner. Delays caused by your failure to respond or provide required documents are not the responsibility of BidHound.
  
  

7. Sensitive Data & Document Handling
   In connection with the SAM.gov Onboarding service, you may be asked to provide sensitive business documents including but not limited to: articles of incorporation, EIN documentation, banking information, and identification documents.
   You acknowledge and agree that:

Documents and sensitive data are collected solely for the purpose of completing your SAM.gov registration.

Payment information is processed through Stripe, a third-party payment processor.

BidHound does not store credit card numbers or full banking credentials on our servers.

BidHound uses reasonable administrative, technical, and physical safeguards to protect
your data, but cannot guarantee absolute security. You provide sensitive documents at your own risk.

In the event of a data breach, BidHound's liability is limited as described in Section 11.
You represent that you are authorized to submit all documents provided to us on behalf of your business.

BidHound will not sell, share, or disclose your sensitive documents to third parties except as required to complete your registration or as required by law.

8. Data & Content
   BidHound provides access to data from public government sources including SAM.gov. We do not guarantee the accuracy, completeness, or timeliness of this data. You are solely responsible for decisions made based on information retrieved through BidHound.

9. Service Availability
   We strive for continuous operation but do not guarantee uninterrupted access, error-free performance, or compatibility with all devices. We may modify, suspend, or discontinue parts of the Service at any time without liability.

10. Third-Party Services
    The Service integrates with external sources including SAM.gov, Stripe, and cloud hosting providers. We are not responsible for the availability, accuracy, or actions of those services, or for issues caused by their outages, rate limits, or policy changes.

11. Limitation of Liability
    To the fullest extent permitted by law:

BidHound is provided "as-is" without warranties of any kind, express or implied.
We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of business, lost profits, or lost data.
We are not liable for outcomes related to SAM.gov registration, including rejection, delays, or loss of contract opportunities.
We are not liable for unauthorized access to data you provide, including sensitive business documents, beyond what is required by applicable law.
Our total liability to you shall not exceed the total amount you paid to BidHound in the 12 months preceding the claim.
We are not liable for actions or omissions of third-party service providers including Stripe, SAM.gov, or our hosting infrastructure.

12. No Guarantee of Results
    BidHound does not guarantee that use of the Service will result in winning contracts, obtaining government certifications, or generating business revenue. All outcomes depend on factors outside our control.

13. Indemnification
    You agree to indemnify and hold harmless BidHound and Fossil Technologies, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, provision of inaccurate or fraudulent information, or violation of any law or third-party rights.

14. Intellectual Property
    BidHound, its design, branding, software, and content (excluding government-provided data) are owned by Fossil Technologies and protected under applicable laws. You may not copy, reverse-engineer, or replicate our Service.

15. Account Termination
    We may suspend or terminate your account for violations of these Terms, abusive or unauthorized activity, or discontinuation of the Service. No refunds will be issued upon termination for cause. Upon termination, your access ends immediately.

16. Dispute Resolution
    Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in the State of Delaware, rather than in court, except that either party may seek injunctive relief in court for intellectual property violations. You waive any right to a jury trial or class action lawsuit.

17. Changes to These Terms
    We may update these Terms at any time. Continued use after an update constitutes acceptance. For significant changes, we will notify you by email or in-app notification.

18. Governing Law
    These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
